Legal question about reusing user contents
« on: June 25, 2014, 12:34:21 pm »
If someone develops a game, so can that one use, for example, OLX skins, frontends, mods etc. (all those contents created by users of OLX), for that new game free of charge and processes?

I.e., that kind of contents is:

- Propriety of person that designed it;

- Propriety of OLX;

- Totally free to use in other softwares

I'm not a lawyer,

but my understanding of the matter is the following.

OpenLieroX is published under the GPL License - that is - the SOFTWARE and CODE.

When it comes to user submitted content, things are different.
Every time I create something, international copyright automatically gives me full license and rights. Legally, I am the only one allowed to use the image, non-profit and profit.

When I upload something to filebase, there is no "sign" telling me that I revoke my rights. So the images are still mine.

But still, things like these are treated as "giving to the community in good faith", for example, I make something, another user makes a minor edit and passes it off as his own work, I would probably win the case if I want to sue him. But this is very unlikely. Most artists like their work being used and played.

Now when you use these images for non-Liero purposes, you are still bound by copyright. The original artists are the sole owners of the rights of distribution. You can not assume that you can freely use these files.

The best thing you can do is ask the original artist if you can use the files, especially if you intend to make money with them.

In most cases, however, I think the original artists couldn't care less, and it's hard to find them.

It would be interesting to read some about similar cases, I'm sure stuff like this has happened before.

just saying, making levels mods skins or any kind of things for games what you dont own (far as i know no1 owns liero ''series'') is gifting, you upload your shit to filebase, we do w/e we want to do with it. you dont like it? well stop uploading them then.

That's how it goes IRL, but Kokbira seemed to be interested in like legal stuff.
And you are wrong as one can be.

Suppose I make some art for a Coca-Cola campaign. It's my art 100%, if I don't use registered other works, it only becomes Coca-Cola's property if I sign a contract with them.

This is my contract with openlierox.net / filebase:

those are forums rules made up by some random guy :D

You also agree not to post any copyrighted material unless you own the copyright or you have written consent from the owner of the copyrighted material. Spam, flooding, advertisements, chain letters, pyramid schemes, and solicitations are also forbidden on this forum.

this part is not about levels what players have made. it is about (for example)
making gameplay video and using copyrighted song without artists permission, or making level where you dont have permission to use your background image and then ''release'' them in lx

and online free source video game is different thing than multi billion soda company

well i have seen tons of maps taken (when i say taken i rly mean taken 0 changes made) from soldat and tons of skins taken from other games for liero.

not 100% sure but i think you are allowed to use --->TEXTURE<--- stuff in other games IF you are not, then liero is full of criminals.
